A car accident comes with several questions. Who is at fault? Who covers the damages your car sustained? Who will cover your medical bills? How much should you receive for pain and suffering? Can you request the insurance company to cover the cost of lost wages?
An experienced Idaho Personal Injury Lawyer at Litster Frost Injury Attorneys can be of great help in negotiating the often confusing and chaotic world of insurance settlements and claims.
Hiring a personal injury lawyer to represent you following an auto accident means that you will have an expert working for you, one who’s highly knowledgeable about the applicable laws and procedural rules that might affect your claim.
Attorneys can advise you concerning any time limits (known as the statute of limitations), which can deter you from filing a claim against the at-fault party. For example, in Idaho, you must file your claim within 2 years of your auto accident or forfeit your right to file a claim. A personal injury lawyer will also be able to advise you on any exemption to this statute of limitations, such as an accident involving minors.
An attorney can file a lawsuit on your behalf and mitigate any possible defenses raised by the other party. Once your case is filed, your attorney may play a huge role in preparing your claim for a trial if your case fails to settle. Although a lawsuit is unlikely, the threat of legal action provides strong leverage for negotiating a reasonable settlement.
There is a plethora of work that goes into negotiating with an insurance company or filing a personal injury lawsuit. After a car accident, you should focus on your recovery and leave all of the work to an experienced attorney.
Although this may be your first time handling an accident claim, injury lawyers have handled all types of claims with various insurance companies. They also have the knowledge and resources to obtain the necessary evidence to support your claim, such as gathering witness statements, lost wage and employment information, medical bills and records, and police reports.
An attorney will also be able to compile the evidence and prepare a settlement demand letter for your insurance company. If you’re unable to settle your accident claim, an attorney can handle all of the necessary paperwork to start building a court case and interact with defense attorneys on your behalf.
Having someone knowledgeable enough to handle all the leg work of your case eases the burden on you, which is highly crucial if you’ve been severely injured and are trying to recover from a vehicle collision.
Most injury lawyers are employed on a contingency-fee basis, meaning they only receive a payment if there’s a successful resolution to your claim. For this reason, in most cases, it’s unlikely that a driver will try handling claims by themselves.
If you have sustained injuries in a car accident, hiring an auto accident attorney will nearly always ensure a more deserved settlement. Contact Litster Frost Injury Lawyers today or book a consultation online to discuss your case.
